In Ohio, paternity must be established when a child is born to unmarried parents. Without legal paternity, the biological father does not have custody, parenting time, or child support obligations. Establishing paternity creates a legal relationship between the father and the child, ensuring the child’s rights to financial support, inheritance, and access to medical history.

 

Being listed on the birth certificate alone is not enough to establish legal paternity in Ohio. Legal paternity must be established through an Acknowledgment of Paternity Affidavit, genetic testing ordered by the Child Support Enforcement Agency (CSEA), or a court order.

If a father motions the court for a finding of paternity, child support will automatically be assessed as part of the process. Once paternity is established, the father can seek custody or parenting time, and the court can issue orders for child support. Establishing paternity is a crucial step to ensure both parental rights and the child’s legal protections.
