You can file for emergency custody when a child is in immediate danger or at significant risk of harm. Courts grant emergency custody only in urgent situations where waiting for a standard custody hearing could jeopardize the child’s safety or well-being. Common circumstances include:

  1. Abuse or Neglect: Evidence that the child is being physically, emotionally, or sexually abused, or is suffering from neglect that endangers their health or safety.

  2. Substance Abuse: The custodial parent is engaging in substance abuse that puts the child at risk, such as impaired caregiving or unsafe living conditions.

  3. Domestic Violence: Exposure to domestic violence in the home that threatens the child’s physical or emotional safety.

  4. Abandonment: The child has been left without proper care or supervision, or the custodial parent has abandoned their responsibilities.

  5. Unsafe Living Conditions: Dangerous or unhealthy conditions in the home, such as exposure to hazardous environments or lack of basic necessities.

  6. Parental Incapacity: A parent’s mental health crisis, incarceration, or other inability to provide safe care for the child.

  7. Threat of Removal: The custodial parent threatens to flee with the child, potentially violating custody orders or putting the child in danger.

To file for emergency custody, you must provide strong evidence supporting the claim of immediate risk, such as police reports, medical records, witness statements, or photographs.

 

The court may hold an ex parte hearing (without the other party present) to determine whether to issue a temporary emergency order. This order is short-term, and a follow-up hearing is scheduled to allow all parties to present their arguments before the court decides on longer-term custody arrangements.
